Sh. Ravindra Kumar, Ld. Additional PP for the State
with IO of the case in person.
Ld counsel for accused submits that accused/applicant
has been named in the disclosure of co-accused only and cheated
amount has already been deposited by co accused persons namely
Ashish and Raju during bail application of accused Ashish.
Submissions be taken on record.
IO submits that applicant has been named in the
disclosure of co accused persons and there is CDR connectivity of the
applicant with co accused persons.
Submissions of all parties heard.
As there is only allegation in disclosure of co accused
persons against accused/applicant and there is CDR connectivity,
cheated amount has already been secured. In these facts and
circumstances, applicant/accused Vivek Kumar is directed to join the
investigation as and when required by the IO without any excuse. Till
then, interim protection from arrest is granted to
accused/applicant. IO is directed to file detail report on NDOH.
