Exemption application filed on behalf of accused
Monika. In the interest of justice and considering the grounds in
the application, same is allowed for today only.
At this stage, an application for taking out pen drive
from the judicial file for preparation of copy, filed by WSI Divya.
Relevant portion of the application is reproduced
herein below:
“In this regard, it is submitted that there is no additional
copy of the said pendrive is available, as the original pendrive
was deposited in the judicial record.

It is therefore necessary to take out the said pendrive
from the judicial file for preparation of its copy, so that the same
may be supplied to the accused persons in compliance with the
directions of this Hon’ble Court and in accordance with law.
It is further submitted that the said pendrive shall be
redeposited in the judicial file immediately after completion of
the necessary formalities.”
Considering the submissions of the IO and grounds
of the application, it will not be proper that pen drive be taken
out from the judicial file outside the custody of court but to
balance the right of fair trial of the accused, it is directed that the
copy of the pen drive be prepared through the copy agency with
the aid of the Computer Branch subject to the applicable rules.
The cost be borne by the prosecution. At the time of the process
of making copy of pen drive, the Ahlmad of this court and the IO
concerned will take the pen drive to the copying branch and as
per the directions of the incharge copying branch and aid of
computer branch, the copy has to be prepared in front of them
and after the process of copying is done, the pen drive has to be
brought back and be kept in court custody / judicial file. This
exercise has to be done on 12.03.2026 from 02:00 pm to 04:00
PM. It is again made clear that the pen drive has not to be left
unattended during the said period.

With these directions, present application is
disposed off accordingly.
