Ms. Apoorva Sharma, Ld. counsel for defendant (VC).
An application u/s. 151 CPC has been filed on behalf of
plaintiff for summoning of the plaintiff's witness. In the application,
it is mentioned that plaintiff wants to examine the Registrar of Trade
Marks, Chennai, who can explain and prove in respect of the
registration in Class 35 along with the entire record of the registration
nos. 3045343 and 4364008 in Class 35, and it is prayed that the present
application may be allowed.
Learned counsel for the defendant states that she has no
objection if the present application filed by the plaintiff is allowed. It
is stated by learned counsel for defendant that the next date of hearing
before the learned Local Commissioner for examination of witness is
17.03.2026.
Heard. For the reasons stated in the application, the
present application filed on behalf of plaintiff is allowed. Witness i.e.
the Registrar / Assistant Registrar / Deputy Registrar of Trade Marks,
Trade Marks Registry, I.P. Building, Industrial Estate, Sidco RMD,
Godown Area, GST Road, Guindy, Chennai 600032, Tamil Nadu,
Email : TMRCHENNAI@NIC.IN, as mentioned in para 2 of the

application filed by the plaintiff, be summoned on filing of PF along
with the requisite record for the next date of hearing i.e. 17.03.2026
before the learned Local Commissioner.
Dasti summons be also provided to the learned counsel
for plaintiff.
Diet money be paid at the spot.
Application u/s. 151 CPC filed on behalf of plaintiff is
disposed off accordingly.
Renotify the matter before the Court for report of
learned Local Commissioner on 08.04.2026.
