Matter is fixed for application under section 5 of Limitation
Act.
Adjournment is also sought on behalf of both the parties as
both the parties are willing to settle the matter.
On the last date of hearing, similar submission was put by
the parties and matter was adjourned by the court. Petitioner was directed to
appear today before the court and no exemption shall be allowed. However,
petitioner is not again absent today.
Considering the conduct of both the parties, no ground is
made out to adjourn the matter but in the interest of justice, matter is
adjourned subject to cost of Rs. 1,000/- each to be deposited in DLSA (New
Delhi). Both parties are directed to deposit the cost and file the receipts on
next date.
Put up for settlement, if any/arguments on 10.02.2026.
