This is the anticipatory bail application under Section 438 Cr. PC moved on
behalf of applicant/accused Prince Kalyan.
Reply to the bail application by investigating officer filed.
Arguments heard. Record perused.
The FIR in the present case was registered on the complaint filed by Mr.
Virendra Singh on behalf of M/s DHL Express India Ltd. With the allegations that in the parcel
booked by one Samuel S for Philippines, 300 sim cars were found. During the course of
investigation the said Samuel S disclosed the name of the applicant/accused on whose instance
the alleged sim cards were to be sent.
It is submitted by Ld.counsel for the applicant/accused that the
applicant/accused has been falsely roped on the basis of disclosure of other accused and there is
nothing incriminating against him. That the applicant is ready and willing to join and cooperate
in the investigation. It is requested that the anticipatory bail may kindly be granted.
Taking into consideration the submissions made, the applicant/accused
Prince Kalyan is directed to join the investigation in the PS Special Cell on 16.05.2024 at
10.00 AM. The applicant/accused Prince Kalyan shall not be arrested till next date.
Be put up for further report/arguments on the bail application on 20.05.2024.
Copy of this order be given dasti to Ld. Counsel for applicant/accused and the
investigating officer.
