dated 30.04.2021, the undersigned has been deputed for duty today to hear
and dispose of fresh bail/urgent criminal applications and pending bail
applications pertaining to New Delhi District.
Matter is taken up through Video Conferencing.

In the present case it has been alleged against the accused that he is
presently working as a Sr. Technical Assistant in IGL and at the time of his
recruitment as a Jr. Technician he submitted his forged ITI Mechanical/Fitter
certificate in the year 2008. The matter came into the notice of the department
and disciplinary proceedings were also initiated and it has already been
concluded with the observation that his suspension was revoked and his
suspension period was treated as a period on duty with all consequential
benefits i.e. release of portion of his salary and allowance withheld by the
department during the suspension period.
From the observation of the disciplinary authority it is clear that
accused has not been removed from the services and he is still serving in the

department and accused has already challenged the observations of disciplinary
authority before the Hon’ble High Court which is already pending.
So far as investigation qua the present matter is concerned, IO has
verified the documents. IO has submitted that investigation in this case is going
on. On being inquired from the IO about the joining of the investigation by the
accused, he has stated that accused has already joined the investigation as and
when he has been called but still investigation is pending. No apprehension of
his absconding has been shown,he is working in a public sector company and no
previous criminal antecedents are shown.
In these circumstances, considering the facts and circumstances
and the above observations, it is directed that three days prior notice shall be
served upon the accused Prabind Kumar Singh in the eventuality of his arrest.
However, accused is directed to join the investigation as and when directed by
the IO. With this observation application is disposed of. Copy of the order be
given dasti.
It is certified that proceedings conducted through VC on CISCO
WEBEX, the quality of audio and video were clear and uninterrupted to the
satisfaction of the participants.
