Present : Plaintiff in person with Counsel.
Sh. Sumesh Gandhi, Counsel for the defendant.
Today, counsel for the defendant has handed over a
cheque of Rs.87,500/- bearing no.673158 dated 08.04.2025 drawn
on Indian Bank in favour of the plaintiff to the plaintiff towards the
rent from April 2023 till date. Same has been accepted by the
plaintiff.
Separate statement of the plaintiff as well as counsel
for the defendant have been recorded in this regard.
Put up on 16.07.2025 for further proceedings.

At this stage, plaintiff has appeared in person before
the court and submitted that the afore-stated cheque handed over to
him in the morning is in the name of “Naresh Kumar Chand”
instead of “Naresh Kumar”. He prayed that defendant may be
directed to collect the said cheque from him and a fresh cheque in
the name of “Naresh Kumar” may be issued as the cheque in
question cannot be encashed.
Heard. Perused and considered.
Considering the submission made by the plaintiff,
defendant is directed to hand over a fresh cheque in the name of
“Naresh Kumar” and receive the cheque in the name of “Naresh
Kumar Chand” against due acknowledgment.
