Summon issued to defendant not received back.
Perusal of the record reveals that the process fee for issuance of the
summon was filed by the plaintiff only a few days back on
24.07.2026.
Plaintiff is directed to take fresh steps for service of
the defendant. Let fresh summons of suit be issued to the defendant
through all modes including e-mode, on filing of PF/RC, speed
post and approved courier for 25.11.2026.
Steps be taken within two weeks.
Ld. Counsel for the plaintiff is directed to file an
affidavit affirming the e-mail address of the defendant under Rule
12 of Delhi Courts Services of process by courier and electronic
mail service (Civil Proceedings) Rule, 2010.
In terms of Rule 13, plaintiff is further directed to
place on record a copy of the plaint and documents in electronic
form/scanned images in compliance of Rule 13 for
forwarding/annexing/attaching the same with the process. A
requisite process fee for sending process by e-mail in compliance

of Rule 14 be filed alongwith copies as above for onward
transmission to Nazarat Branch, Patiala House Courts for service
through e-mail.
The summons to defendant shall indicate that a
written statement alongwith statement of truth and affidavit of
admission/denial of documents shall be positively filed within
stipulated period from the date of receipt of summons.
