This is an application u/s 439 CrPC for grant of
regular bail filed on behalf of applicant/accused Farukh @
Shazada.
Presence: Sh. Santosh Kumar, Ld. Addl. PP for State.
IO W/SI Babli in person.
Sh. Feroz Haider, Ld. Counsel for
applicant/accused.
1. Vide this order, I shall decide the application of bail filed
under Section 439 CrPC by applicant/accused Farukh @
Shazada.
2. Reply to the present bail application has been filed by IO. Copy
supplied.
3. In brief the facts of the case are:
That on 29.03.2024, the present FIR bearing no. 32687/2024
was registered through online portal on the complaint of Mr. Nikhil
Gupta, regarding theft of his mobile phone make Motorola Green
Colour. On 31.03.2024 vide DD entry no.29A, applicant/accused
Farukh @ Shazada got arrested in another FIR bearing no. 248/2024
u/s 25/54/59 Arms Act of PS Seema Puri, in which the aforesaid
mobile phone make Motorola Green Colour got recovered.
4. Arguments are advanced from both the sides.
5. It is submitted by Ld. Counsel for applicant/accused that
applicant is in custody since 03.04.2024; that recovery has
already been effected from him; that applicant/accused is no
more required for any custodial interrogation. Thus,

applicant/accused be set at liberty.
6. Ld. Addl. PP for State assisted by Investigating Officer has
strongly opposed the present bail application, on the ground of
several previous involvements of applicant/accused.
7. I have heard the arguments from both the sides.
8. The charge-sheet in the present case has been filed,
recovery has already been effected from applicant/accused. There
is no requirement of applicant/accused Farukh @ Shazada for
any custodial interrogation. Hence, applicant/accused Farukh
@ Shazada S/o Noor Mohd., is admitted to bail on furnishing
bail bond in sum of Rs.30,000/- with one surety in the like
amount, subject to the following conditions:-
1) Applicant/accused shall mark his attendance in the
Police Station-Rajiv Chowk in every week.
2) Applicant/accused shall not misuse the benefit of bail by
indulging himself of similar offence in future.
2) Applicant/accused shall appear before the court on each
and every date of hearing.
3) Applicant/accused shall not try to influence/ threaten the
complainant or any other witness in the present case.
9. Copy of the order be given dasti.
