BANK OF BARODA v. MR. KAMLESH PATHAK
    18.07.2026 (At 10:32 a.m.)
    Present: None.
As per report received, defendant was served with the
summons with complete paper book through WhatsApp on
14.05.2026. From the documents placed on the record, I can find
same WhatsApp number being mentioned by defendant in his
application form (Annexure-II). Accordingly, defendant is
deemed to be served on 14.05.2026.
The stipulated time period of 30 days from the date of
service is already over and till date no WS has been filed on
behalf of the defendant. There is no application for extension of
time and there is no reason for this court to presume any reason
for the defendant, in order to extend the time limit as provided
under VIII Rule 1 CPC. Hence, opportunity to file Written
Statement is closed. Accordingly, matter is now fixed for
    evidence of plaintiff.
On next date, witness of plaintiff shall appear along
with all the original relied upon documents, if not so filed, and
affidavit. Put up on 27.11.2026, for plaintiff’s evidence and final
    submission.
