Defendant remained unserved.
Plaintiff has moved an application under Section 151 CPC in
the matter praying for dasti summons. Ld. Counsel for the plaintiff submits
that the defendant is consciously and deliberately avoiding service of
summons. It is intimated to the Court that defendant is duly appearing in a
Court in Kairana, Shamli, U.P.
Accordingly, let the defendant be served afresh on filing of
PF/RC/Speed post/Courier-AD as well as through approved electronic
mode for the next date of hearing. Process be issued dasti also. Ld. District
Judge, Shamli Uttar Pradesh is also requested to permit the plaintiff to get
the defendant served there in the Court as defendant is reported to be
appeared in a complaint case bearing no.1316/22, CNR No.
UPSM100020582022 pending trial before the Ld. Additional Civil Judge
Magistrate Kairana, Shamili and the next date of hearing is reported to be
07.10.2025.
The plaintiff is directed to take steps within 3 days from
today for service upon the defendant.
Now to come up for service report of the defendant in the
matter on 05.02.2026.
