Present is an application moved on behalf of applicant
Sangeeta Garg for grant of anticipatory bail.
At this juncture, it is proposed by Ld. defence counsel
appearing on behalf of the applicant that in order to be fair to the
investigating agency, he is inclined to withdraw the instant bail application
subject to the condition that in case, if during the course of investigation,
the investigating agency finds the arrest of the applicant to be imminent and
unavoidable, then, advance seven working days’ notice shall be served upon
the applicant whereby she can exercise her legal remedies available under
the law.
Ld. Addl. PP for State fairly concedes to the same subject to
the condition that applicant is directed to join the investigation. Ld. Counsel
for the complainant also fairly concedes to the same.
In view of the submissions made, the application stands
disposed of as withdrawn with directions to the IO that in case if during the
course of investigation, the arrest of the applicant is found imminent,
applicant Sangeeta Garg be given advance seven working days’ notice so
that she can avail the available legal remedies.
Applicant Sangeeta Garg is directed to join the investigation
in the instant matter as and when called by the IO.
Application is disposed off accordingly.
