applicant/accused Ishtikar @ Sonu.
This is an application for reduction of surety amount of
bail order dated 14.01.2021 passed by Sh. Dharmender Rana, Ld.
ASJ-02, PHC, NDD, ND moved on behalf of applicant/accused
Ishtikar @ Sonu who is lodged in JC since 01.11.2020.
The applicant/accused Ishtikar @ Sonu was admitted to
bail vide order 14.01.2021 on furnishing surety bond for a sum of
Rs.30,000/- with one surety of like amount.
It is stated in the application that family of
applicant/accused is not financially sound due to which he is not able
to furnish the surety amount of Rs.30,000/-. Therefore, it is prayed
that surety amount may kindly be reduced.
The present application is strongly opposed by Ld.
Additional PP for the State.
The applicant/accused has been admitted to bail for a
sum of Rs.30,000/- vide order dated 14.01.2021. The
applicant/accused has not yet been released on bail in the present case
and still lodged in JC due to non-furnishing of personal bond and
surety bond. This fact itself shows that accused is not in a position to
arrange the surety for surety amount as ordered on dated 14.01.2021.

Accordingly, considering all facts and circumstances of
the present case and submissions made by Ld. Counsel for the
applicant/accused, I am inclined to allow the present application.
Applicant/accused Ishtikhar @ Sonu is directed to be
released on bail on furnishing personal bond and surety bond in the
sum of Rs.15,000/- with one surety of like amount to the satisfaction
of Ld. MM/Duty MM/ Reliver MM.
Application disposed off.
