Director Sanjeev Dhaulta in person.
1. An application under Order 1 Rule 10 (IA No. 1/2026) seeking deletion D2, 3 and 5
has been filed alongwith amended memo of parties, amended plaint and amended statement of
truth on behalf of the Plaintiff.
2. Same is taken on record.
3. Heard. Record perused.
4. Vide order dated 07.08.2026, plaintiff was directed to delete all the Director of D-1
Company who have been arrayed as D-2 to D-5 as Defendants. The application so filed by the
Plaintiff seeks deletion of D-2, 3 and 5 and does not mentions Defendant no.4, who is also one of
the Directors of the Defendant Company, and no liability can be fasten upon him also without
there being any personal undertaking or personal liability.
5. In the given facts, the application under Order 1 Rule 10 CPC stands allowed.
However, at the same time Plaintiff is also directed to file fresh amended memo of parties by
deleting Defendant no.4 also from the array of Defendants.
7. Accordingly, Defendant No.2 to 5 stands deleted from the array of parties.
8. Further, application under Order 6 Rule 17 (I.A No.2/2026) stands allowed subject
to the cost of Rs.3000/- to be paid to the DLSA.
9. Amended Plaint alongwith amended Statement of Truth is taken record.
10. Let summons be issued as per the amended memo of parties to the Defendant
through all permissible including electronic modes on filing of PF.
11. Plaintiff is directed to file an affidavit furnishing registered mobile number and
email of the Defendant. Steps be taken within one week from today.
12. Put up for further proceedings on 08.12.2026.
