The present suit is being carried by the undersigned in terms of
transfer order no. 32/D-3/GazIA/DHC/2026 dated 01.08.2026
since the present matter was reserved for the orders.
Present: Sh. Vishal Gohri, Ld. counsel for plaintiff through
VC.
Sh. Lalit Kumar, Ld. counsel for defendant through
VC.
Vide separate order of even date, present application
so filed by the plaintiff under Order XII Rule 6 CPC, with respect
to possession of the suit property stands allowed. Defendant is
directed to hand over the possession of the suit premises i.e.
bearing no. 4, Upasana Building, One Haily Road, New Delhi, to
the plaintiff within two months of passing of this order. The
defendants however, shall pay rent for the abovesaid duration to
the plaintiff, as per the last paid rent. It is further clarified that
suit of the plaintiff shall continue for other pending relief of
recovery of arrear of rent and damages. Application stands
disposed off accordingly. Decree sheet be prepared.
Now to come up for further proceedings on
27.11.2026.
Ahlmad is directed to send back the file to the court
of Ld. DJ-05, Patiala House Court against due acknowledgment.
