Present: Sh Vishal Gohri, Ld. Counsel for the plaintiff
Sh Sharan Mehta and Neeraj Kant, Ld. Counsel for the
defendant
It has been stated by counsel for defendant that they have
already made the payment of Rs. 27 lakhs (after deducting TDS) to the
plaintiff and they will make the remaining payment within 10 weeks.
Strongly objected to by the counsel for plaintiff on the ground that
defendants are still enjoying suit property. It is stated that defendants be
directed to handover the possession of the suit property to the plaintiff.
Plaintiff is directed to move appropriate application in this
regard.
Pleadings in the present matter are already completed.
On the basis of pleading, the following issues are framed:
1. Whether the plaintiff is entitled for possession of suit property in
question , as prayed for? OPP
2. Whether the plaintiff is entitled for arrears of rent, as prayed for? OPP
3. Whether the plaintiff is entitled for occupational charges/ damages/
mesne profits, as prayed for? OPP
4. Whether the plaintiff is entitled for relief of injunction, as prayed for?
OPP
5. Relief.

No other issues arises or pressed upon.
Affidavit of admission and denial already filed.
Case is now fixed for PE. Evidence by way of affidavit
alongwith list of witnesses be filed with advance copy to the counsel of the
defendant atleast one week prior to the next date of hearing. Both the parties
are also directed to file list of witnesses within 15 days.
