Counsel for Plaintiff. Defendant no.1 ex-parte vide order dated 20.01.2026. Ms. Varsha, Proxy Counsel for Defendant no.2. PW1 Dheeraj Kumar Pandey in person. PW1 tendered his evidence by way of affidavit. Proxy counsel for defendant no.2 seeks a short adjournment to cross-examine the witness submitting that mother of main counsel for defendant no.2 is hospitalized. Adjournment plea is vehemently opposed by counsel for the plaintiff. She submits that on the last date of hearing despite genuine grounds of witness, adjournment plea was opposed by defendant no.2. She submits that defendants are intentionally attempting to delay trial and the witness has come down all the way from Bihar just to testify in the instant matter. This Court has full sympathies with the precarious situation of counsel for defendant no.2 , however, this Court finds itself dutybound to address the concerns of plaintiff’s counsel with respect to the time of witness. In these circumstances, to counter-balance the conflicting interests, the cross-examination of PW1 is deferred subject to cost of Rs.10,000/- to be paid to the witness by defendant no.2. -1- -- 1 of 2 -- -2- Accordingly, list for cross-examination of PW1 in the matter on 07.01.2027.
