Present: Sh. Aditya Saluja, ld. counsel for the plaintiff.
Ms. Jyoti Dwivedi, ld. counsel for defendant.
Vakalatnama filed on behalf of defendant. Though as
per report, defendant was served physically on 31.05.2025.
However, ld. counsel for defendant submits that some pages from
the paper book were missing.
Ideally such objection should have been raised before
the court immediately after the service. However, keeping in
view the fact that the maximum period of 120 days is yet to
lapse, a fresh set of paper book has been supplied to ld. counsel
for defendant from the record itself.
Ld. counsel for the plaintiff submits that at least cost
should be imposed upon the defendant. Accordingly subject to
cost of Rs.500/- (as demanded by ld. counsel the plaintiff),
defendant is given further period of 10 days from today to file
Written Statement along with all other requisite pleadings in
accordance with Commercial Court Act, after supplying advance
copy of the same to the opposite counsel. On next date plaintiff
may file replication and shall file an affidavit of
admission/denial, if any document is relied upon by the
defendant and supplied to him. Cost paid to ld. counsel for
plaintiff.
