Present: Sh. S.Y. Usmani, Ld. Counsel for appellant with
appellant in person.
The present appeal has been filed u/s 415 BNSS against
judgment dated 16.12.2024 whereby the appellant has been convicted
for an offence punishable u/s 138 NI Act and order on sentence dated
03.02.2025 whereby the appellant has been directed to pay
compensation of Rs.30,80,000/- (Rupees Thirty Lacs Eighty Thousand
Only) to the complainant u/s 357(3) Cr.P.C. within 30 days. In default
of the payment of the compensation to the complainant, the convict
has been directed to undergo SI for three months.
Along with appeal, one application u/s 389 Cr.P.C. /
430(1) BNSS for suspension of the sentence has also been filed. The
sentence imposed upon the appellant is suspended till the NDOH
subject to the appellant depositing 20% of the compensation amount
by way of FDR in the name of ‘Principal District and Sessions Judge,
NDD, PHC, New Delhi’, within 60 days from today before Trial
Court. He is further directed to furnish bail bond/surety bond in the
sum of Rs.50,000/- to be furnished before the Trial Court concerned.
Compliance report be filed on the NDOH.

Notice of the appeal be issued to the respondent through
all modes. Let process be filed within one week.
TCR be also summoned for the NDOH.
