In the present matter, this court has allowed the
application under Order 1 Rule 10 CPC filed by the plaintiff on
28.10.2025 whereby Sh. Nemi Kumar Goyal and Mr. Himanshu
Goyal were impleaded as party to the present suit.
In lieu thereof, amended plaint has already filed on
behalf of plaintiff along with amended memo of parties.
Today one Sh. Deepanshu Tehran, appeared through
VC. He stated that he is appearing for defendant, however his voice
is not clear and could not be heard properly.
Ld. Counsel for plaintiff objected to the same primarily
on the ground that different counsels are being appearing on behalf
of defendant on each and every date and it is not clarified as to
whose behalf Sh. Deepanshu Tehran has appeared. It is further
stated that as per previous order sheets, several counsels have been
appearing on behalf of defendant however no Vakalatnama has been
filed on their behalf.
In the interest of justice, one more opportunity is given
to defendant to file amended written statement, if any, with advance
copy to the opposite side.

It is clarified that this shall be the last and final
opportunity to the defendant to proceed further with the matter.
Now to come up for filing of amended written
statement, if any/further proceedings on 01.09.2026.
