Joint written statement filed on behalf of defendants on 01.10.2022 is
on judicial file along with application under Order VIII Rule 1 CPC seeking
condonation of delay in filing the written statement. Another application under
Section 151 CPC seeking waiver of cost imposed on 26.05.2022 is also on record.
Reply to the applications filed by the plaintiff under Section 151 CPC,
under Order XXVI Rule 9 CPC and under Order XXXIX Rule 1 & 2 CPC have also
been filed by the defendants along with written statement.
Counsel for defendants has submitted that he has already supplied the
copy of the written statement to the plaintiffs. Proxy Counsel appearing on behalf of
plaintiffs has submitted that she has not received the said copy. Defendants are
directed to supply the hard copy of the written statement as well as reply to the
applications to the plaintiff during the course of the day.
On the last date of hearing, defendants were granted extension of two
weeks time to file written statement but the same was filed only on 01.10.2022.
Put up for reply/arguments on 20.02.2023.
