Present: Mr. Sachin Mittal, Ld. counsel for Plaintiff
Mr. Dipanshu Trehan, proxy counsel for Defendant
(through VC)
Evidence by way of affidavit along with the list of
witness has been filed in court today by the Plaintiff. Proxy counsel
for the Defendant submits that he has been supplied with the copy
of the evidence by way of affidavit but has not received the list of
witnesses. Ld. counsel for Plaintiff is directed to supply the list of
witnesses afresh.
In terms of the previous order dated 27.07.2026, cost of
Rs.10,000/- was imposed upon the Defendant to be paid on the
NDOH, for not complying with the previous directions of this court
for producing the original rent agreement dated 04.02.2021. Further,
Defendant was also directed to file its list of witnesses within 15
days therefrom.
Ld. proxy counsel has neither paid the said cost amount
to the Plaintiff nor has he produced the original rent agreement
dated 04.02.2021, nor has the list of witnesses been filed by the
Defendant.
Ld. proxy counsel submits that the main counsel could
not appear today owing to personal loss in his family. While the
court takes sympathetic note of the personal circumstances of the
main counsel, it can also not shun away from the fact that there has

been repeated non compliance of the orders of this court by the
Defendant.
While in the interest of justice, the court does not, at
this stage, see it fit to close the Defendant’s right to cross examine
the plaintiff witnesses, however the costs amount of Rs.10,000/-
stands enhanced to Rs.20,000/- to be paid to the Plaintiff by the
NDOH.
At this stage, PW-1 examined-in-chief. Cross
examination of PW-1 is deferred for want of availability of Ld.
counsel for Defendant.
The matter shall now come up for cross examination of
PW-1 and for further PE on the NDOH.
The NDOH is on 17.11.2026.
