Present: Ms. Shudhi Singh, Ld. Counsel for Plaintiff (VC).
Sh. Vaibhav Chawla, Ld. Counsel for Defendant.
File taken up on an application moved on behalf of
plaintiff. Ld. Counsel for the plaintiff states that plaintiff has instituted
instant suit seeking permanent and mandatory injunction against the
defendant from breaching the terms and conditions of agreement
executed with the plaintiff. The plaintiff is also seeking relief on
damages from causing loose to the reputation and goodwill of the
plaintiff.
She further states that after completion of pleadings, this
Court, vide order dated 02.01.2024 appointed Local Commissioner
for conducting the evidence of parties. The plaintiff supply evidence
by way of affidavit of PW1 on 10.04.2024.
Ld. Counsel further state that the plaintiff’s father is
admitted in ICU at Sir Gangaram Hospital since December, 2023. He
still admitted in hospital. She further states that plaintiff has
exhausted all his earning and savings in getting the medical treatment
for recovery of his father and Ld. Local Commissioner is an
additional expense apart from the ongoing litigation expenses. She
further submits that plaintiff is going through huge financial
constrains due to his family conditions and hence plaintiff is not able
to bear additional expenses to be paid to Ld. Local Commissioner.

Ld. Counsel for defendant submits that he has no
objection in the event, if application is allowed and further referred to
the order dated 01.06.2024 of Ld. Local Commissioner.
It is seen from record that the plaintiff has paid Rs.
2,500/- as fee of Local Commissioner.
At this stage, Ld. Counsel of plaintiff undertakes to pay
balance of outstanding amount as Fee to Local Commissioner.
Having regards to the facts and the circumstances and the
contents of the application, the application is allowed. Ld. Local
Commissioner stands discharged.
Separate intimation in this regard be given to Ld. Local
Commissioner.
Be listed for 31.08.2024 at 11.00 am for plaintiff’s
evidence. It is clarified that no further opportunity will be granted.
PW Sh. Gaurav Chhiber is directed to be present on the date fixed.
