File taken up today on application under Section 151 CPC of
the plaintiff for extension of time of 60 days for recording of plaintiff's
evidence before Local Commissioner along with affidavit.
Present: Sh. Sabhay Chaudhary, Ld. Counsel for the plaintiff.
Sh. Vaibhav Chawla, Ld. Counsel for defendant.
Heard.
The reason mentioned in the application is that father of
plaintiff Sh. Surender Kumar Chibber suffered a brain stroke on 07.01.2024
and still under treatment. The plaintiff is only attendant who is looking
after his ailing father.
The reason mentioned in the application appears to be
genuine and is sufficient to extend the time. Thus, in view of averments
made in the application and no objection given by Ld. Counsel for the
defendant, the application is allowed. Time is accordingly, extended.
Parties are directed to appear before Local Commissioner for
date fixed i.e. 01.03.2024 at 2:30 PM. Local Commissioner may consider
the request of the plaintiff and no adverse be passed.
Parties are also directed to inform in advance in case of any
adjournment.
Put up the matter before this Court on date fixed i.e.
10.04.2024.
