All accused persons are absent.

Sh. Hardik Bedi, Sh. Kapil Choudhary and Sh. Keshav,
Ld. Counsels for accused no. 2, 3 and 4 (fresh
vakalatnama filed on behalf of accused no. 2, 3 and 4.
Same be taken on record).
A joint exemption application has been filed on the
pretext that accused no. 2 is a senior citizen and he is having some
health issues, accused no. 3 and 4 are unable to appear before this
Court as they could not arrange travel tickets from Kashmir to
Delhi. Heard, considered and allowed for today only.
Memo of Appearance on behalf of accused no. 7 and 8.
Same be taken on record.
A report has been filed on behalf of ED qua service of
accused no. 5 and 6 stating that they are not traceable at the given
addresses. It is mentioned in the report that accused no. 5 fled to
Pakistan in year 1990 and thereafter he has not returned back.

Accused no. 6 Aijaz Ahmad Bhat @ Aijaz Maqbool Bhat is not
traceable at the given address. Report perused.
Issue notice to Investigating Officer to appear in person
on NDOH as some clarifications are required from the Investigating
Officer as to in what circumstances, he has filed his complaint
without arrest of all accused persons.
Ld. Counsel for accused no. 7 and 8 submit that he has
no instructions on behalf of accused persons. Again said, he has
instructions from the accused persons to appear before this Court
however he has not explained as to why accused persons are not
appearing before this Court today.
Ld. Counsel for accused no. 1 submits that accused
would appear before this Court through VC but he is absent.
Considering the conduct of accused persons, issue
NBWs against accused no. 1, 7 and 8 through Investigating Officer
for NDOH.
Re-list for appearance of accused persons/FP on
24.10.2026.

At this stage, accused no. 1, 7 and 8 have appeared
through VC. They are warned to be more careful in future.
Accordingly, NBWs issued against them in earlier part of the order
