This is the anticipatory bail application under Section 438 Cr.
PC moved on behalf of applicant/accused Karan Singh.
Reply to the bail application already fixed.
It is submitted by Ld.counsel for the applicant/accused that
the applicant has joined the investigation on previous occasions and ready
and willing to cooperate in the investigation. That the applicant/accused
without prejudice to his rights and contention is ready to refund the alleged
amount to the department. That no useful purpose is going to be served by
sending the applicant behind the bars. It is prayed that the
applicant/accused may kindly be enlarged on bail.
Submissions heard.
In the present case the applicant/accused while working as
Assistant Section Officer in Central Agency Section, Department of Legal
Affairs, Government of India presented forged medical bills to the
department amounting to Rs.2,42,175/- in respect of treatment of his
parents and got reimbursement to the tune of Rs.1,75,646/-.
The present case was registered in the year 2018 and the
applicant/accused has joined the investigation on previous occasions. The
applicant/accused without prejudice to his right and contention, is ready to

refund the alleged amount to the department. In view of aforesaid
circumstances, the applicant/accused Karan Singh is directed to join
the investigation as and when called by the SHO/IO concerned. The
applicant/accused is also directed to deposit alleged sum of
Rs.1,75,646/- with the complainant/department within 10 days from
today. Subject to compliance of aforesaid directions, SHO/IO
concerned is directed not to take coercive action against the
applicant/accused Karan Singh till next date.
Be put up for further report/arguments on bail application on
11.04.2023.
Copy of this order be given dasti to Ld. Counsel for
applicant/accused and the investigating officer for compliance.
