Heard. File perused.
An application u/s 151 CPC for rectification and
modification of order dated 21.9.2023 alongwith another
application seeking exemption from filing certified copy of order
dated 21.9.2023, both moved by plaintiff, are pending
consideration.
After addressing brief arguments, Ld. Counsel of
plaintiff states at Bar that he does not press both the said
applications and seek to withdraw the same.
His statement in this regard has been obtained on
first page of the first application.
In view of aforesaid submission made and the
statement given by Ld. Counsel of plaintiff, both the said
applications are dismissed as withdrawn.
Issue summons of suit to defendant at all available
addresses by all permissible modes on taking requisite steps by
the plaintiff, returnable for next date. Steps be taken within 7
working days.
Written statement has to be filed by the defendant
within 30 days (extendable upto 120 days with the leave of the
court and that too subject to appropriate terms) from the date of
service of the process as per the Proviso of Sub Rule 1 of Order 5
Rule 1 CPC as applicable to the Commercial Courts Act.
