This is an application for grant of anticipatory bail on
behalf of the accused.

Arguments heard and record perused.
The present case FIR was registered on the basis of the
statement of the injured for commission of offence punishable u/s
308 / 34 IPC.
The facts of the case in brief are that on 25.03.2024 at
12.30 pm, the family members of the applicant / accused had quarrel
with the family of the complainant.
On perusal of the MLC, it is found that the injured had
sustained single injury on her head. The iron rod allegedly used in the
commission of offence has already been recovered.
The applicant is 30 year old woman. The facts of the case
are such that no custodial interrogation of the applicant is required.
The identity of the applicant is not in dispute.

In the course of arguments, IO submits that he is not
willing to arrest the applicant if she is ready to join the investigation.
Considering the facts and circumstances, the application
is allowed and in the case of arrest, the applicant/accused is directed
to be released on bail, on furnishing personal bond in the sum of
Rs.25,000/- with one surety in the like amount to the satisfaction of
concerned SHO/IO. This order of anticipatory bail is subject to the
following conditions:-
(i) the applicant shall join the investigation as and when
directed to do so;
(ii) the applicant shall intimate the court of Ld. Ilaqa/Area
Magistrate in case of change of his address;
I may clarify that nothing expressed herein shall
tantamount to an expression on the merit of present case.
The application stands disposed of accordingly.
