Present: Sh Arun Khatri, Ld SPP for NCB with JIO Manoj
Kumar Yadav.
Both the accused persons are stated to be in JC.
E-Challan filed.
This complaint has been filed by a public servant Sh.
Manoj Kumar Yadav, JIO in discharge of his duties. He has
moved an application for dispensing with his preliminary
examination and for his exemption from personal appearance for
future dates on the ground that he remains busy in official duties
and it is not possible for him to attend the court on each and
every date of hearing and that he be therefore allowed to be
represented through the Special PP. In view of the submissions
made, the preliminary examination of the complainant is
dispensed with and he is exempted from personal appearance
during trial.
Perused the complaint.
It has been alleged in the complaint that on
14.09.2022, NCB, DZU seized 360 gm Amphetamine from
parcel at UPS Express Pvt Ltd., IGI Airport, New Delhi. The said
parcel was booked by accused Saraswati Thakur. During
investigation, the said accused Saraswati Thakur disclosed that

accused no. 2 i.e. Nnaka Christian Ilechukwu @ Efe @ Sylesster
Chinedu Nnaka @ Sylvester Chinedu Udennaka gave her the
parcel to book the same from UPS branch, Jaipur. Both the
accused persons were arrested and investigation proceeded.
In the considered opinion of this Court, the material on
record is sufficient to take cognizance of the offences punishable
U/s 8/22/23 & 29 of NDPS Act.
Let production warrants against both the accused
persons be issued for the next date of hearing.
To come up for further proceedings/supply of copies
of documents on 17.04.2023.
