This is an application u/s 439 CrPC seeking regular
bail filed on behalf of applicant/accused Vivek Verma.
Presence: Sh. Santosh Kumar, Ld. Addl. PP for State.

applicant/accused.
1. Reply has been filed by the Investigating Officer. The
same is perused and is taken on record.
2. In brief: On 16.03.2024, an information was received vide
DD entry No. 3A in Police Station- Connaught Place, regarding
theft in AU ATM Machine, K-19, Outer Circle Connaught Place,
New Delhi. On receipt of the information, police officials
reached at the spot. It was found that one caller namely Mr.
Lakhveer Singh was calling on behalf of the AU Small Finance
Bank, K-19, Outer Circle Connaught Place, New Delhi. He
informed that a boy was trying to steal cash after breaking the
dispenser shutter of the ATM machine of AU Bank. The caller
also shared the CCTV footage of the incident, wherein a boy
wearing yellow t-shirt was trying to steal cash from the said ATM
machine after hitting a stone on dispenser shutter. Thereafter,
search was made but, no clue was found. Later on, another DD
no. 6A was received in the Police Station, regarding the
apprehension of applicant/accused.

3. Arguments are advanced from both the sides.
4. It is submitted by Ld. Counsel for applicant/accused that
applicant is in custody since 15.03.2024; that applicant/accused
is no more required for any custodial interrogation. Thus,
applicant/accused be set at liberty.
5. Ld. Addl. PP for State assisted by Investigating Officer has
strongly opposed the present bail application.
6. I have heard the arguments from both the sides.
7. The charge-sheet in the present case has been filed. No
recovery has to be effected. There is no requirement of
applicant/accused for any custodial interrogation. Further,
applicant/accused has no previous criminal antecedents. Hence,
applicant/accused Vivek Verma S/o Pyare Lal Verma is
admitted to bail on furnishing bail bond in sum of Rs.20,000/-
with one surety in the like amount, subject to the following
conditions:-
1) Applicant/accused shall not misuse the benefit of bail by
indulging himself of similar offence in future.
2) Applicant/accused shall appear before the court on each
and every date of hearing.
8. Copy of the order be given dasti to Ld. Counsel for
applicant/accused. One copy of the order be sent to concerned
Jail Superintendent for compliance.
