Heard. Perused.
It was inquired from AR of defendant as to whether
defendant is interested in settlement/compromise and AR of
defendant submits he has to take instructions.
It was for the Ld. Counsel for defendant to make the
party understand the purpose of case management hearing and
AR has appeared without instructions and earlier Ld. Counsel for
defendant had been seeking adjournment for compromise.
Even on previous date of hearing, AR of defendant
had not appeared.
After hearing the AR of parties, Ld. Counsel for the
parties and on the basis of the pleadings of the parties, following
issues arise and are framed:
ISSUES
1. Whether plaintiff is entitled for recovery of Rs.
10,58,100/- from defendant as claimed ? OPP.
2. Whether plaintiff is entitled for recovery of any
interest from defendant ? If so, at what rate, for which period
and on what amount ?OPP.
3. Relief.
No other issue is raised nor pressed for.

It is made clear that in case due to any reason the
purpose of which matter is fixed is not concluded, the matter
shall be taken up on the next working day. Any unjustified,
non-compliance of the aforesaid directions and delay in the
above mentioned time lines may lead to consequences for
non-compliance as per Order XVA Rule 8 CPC pursuant to the
schedule U/s 16 of the Commercial Courts Act, 2015.
