Heard. File perused.
At the outset, counsel appearing on behalf of
defendant has informed that previous cost of Rs.3000/- has
already been paid to opposite side, which is fairly not disputed by
counsel of plaintiff.
An application seeking substitution of AR of
defendant company filed. Advance copy thereof already supplied.
Counsel of plaintiff states at Bar that he does not
want to file any written reply to the aforesaid application and also
that he has no objection in case said application is allowed.
Heard on the aforesaid application. Record perused.
Having considered the submissions made on behalf
of both the sides and in view of reasons assigned in the
application that previous AR namely Sh. Aman Bhalla is no more
in the employment of the defendant company and Sh. Dinesh
Kumar has been appointed to represent the company by way of
Board Resolution, the AR namely Sh. Dinesh Kumar is
substituted in place of previous AR Mr. Aman Bhalla.
Accordingly, the application is allowed and disposed off.
Affidavit in evidence of PW Sh.Dinesh Kumar filed.
Copy thereof already supplied.

However, said witness is not present today, who is
stated to be unwell.
Counsel of defendant seeks an adjournment to lead
defendant’s evidence, which is fairly not opposed.
Subject to production of medical treatment record/
certificate of the witness, and also subject to condition that it
shall be last and final opportunity to the defendant to lead its
entire evidence on next date of hearing, the adjournment is
granted.
Put up for entire DE on 05-2-2024. Advance copy of
affidavit in evidence of witness(s) be supplied to opposite side at
least one week prior to next date of hearing. Steps for
summoning of witnesses,if any, as per list of witnesses, be also
taken well in advance.
