ULTRATECH CEMENT LTD. Vs. THEINDOGRID INFRA PVT.
    LTD.
    01.06.2026 (At 10:52 AM)
Present : Sh. Gurvinder Singh, Ld. Counsel for the plaintiff.
One amended plaint along with fresh Statement of
    Truth, Affidavit U/s. 63 BSA, Declaration U/o. 11 Rule 6 CPC and
Court fee of Rs. 8,844/- have been tendered.
I have perused the amended plaint. I find that the
plaint does not disclose all basic facts in respect of all the invoices.
In the prayer clause, interest has been claimed from the respective
due dates. However, the plaint is totally silent in respect of those
due dates and the amount of such interest. Plaintiff has to not only
plead about such interest but has also to plead complete calculation
and has to pay court fee on that interest component also for the
period till filing of this Suit.
Ld. Counsel seeks another opportunity to come up
with fresh amended plaint. Another opportunity is given. The
amended plaint with fresh Statement of Truth shall be filed before
    or upto NDOH.
    Put up on 24.08.2026.

ULTRATECH CEMENT LTD. Vs. THEINDOGRID INFRA
    PVT. LTD.
    22.04.2026 (At 10:56 AM)
Present: Sh. Gurvinder Singh, Ld. Counsel for the plaintiff.
Despite given opportunity, plaintiff did not bother to pay
the complete court fee and the court fee still remains deficient.
Plaintiff was already given directions to rectify the plaint because
there had been number of defects in the plaint including half-hearted
pleadings made about valuation of this suit and ignoring to plead
about particular court fee being payable.
Ld. counsel submits that AR of plaintiff has been
changed, and therefore, rectified plaint could not be prepared.
    Adjournment sought.
Last opportunity is given to ensure that not only the
pleadings are rectified strictly in accordance with provisions of
Commercial Courts Act, but also to pay deficient court fee to ensure
that complete court fee as per amount claimed in this suit has been
paid. Case is adjourned subject to cost of Rs.5,000/- to be deposited
    in DLSA, New Delhi.
    Put up on 01.06.2026.
