From perusal of the record, it is reflected that a
consolidated application under Order 7 Rule 10 CPC and Order
Rule 7 Rule 11 CPC has been filed on behalf of defendant.
Today, the arguments were advanced by the Ld.
Counsel for the parties on the aspect of territorial jurisdiction of
this court in view of the jurisdiction clause contained in the
appointment letter, as per which, jurisdiction has been conferred
upon the courts situated at Mohali.
Judgment of the Hon’ble Supreme Court of India in
Rakesh Kumar Verma v HDFC Bank Ltd., has also been placed
on record, as per which, the previous judgment of the Hon’ble
High Court of Delhi in Vishal Gupta v L&T Finance Ltd., has
been overruled.
Arguments heard.
To come up for clarification, if any/orders on the
issue of territorial jurisdiction of this court to entertain the
present suit/application under Order 7 Rule 10 CPC, on
25.09.2026.
