Ld. Counsel for the defendant filed affidavit of admission and
denial of documents. The same is taken on record.
Perusal of the affidavit of admission and denial of documents
shows that the same is not in accordance with the provisions of Commercial
Courts Act, 2015.
Ld. Counsel for the defendant submits that since the defendant
has to come from Telgana, he needs sometime to file cured one and seeks
adjournment in this regard.
On request, the defendant is allowed to do so with advance copy
of the same to the Ld. Counsel for the plaintiff one week prior to the next
date of hearing.
Ld. Counsel for the plaintiff also seeks time to file reply to the
application under Order 7 Rule 10 CPC.
On request, the planitiff is allowed to do so with advance copy of
the same to the Ld. Counsel for the defendant one week prior to the next date
of hearing.
On joint request, put up this matter for filing of affidavit of
admission and denial of documents by the defendant and for reply and
arguments on the application under Order 7 Rule 10 CPC, on 21.05.2025.
