Counsel for the defendant has filed written
statement; statement of truth; list of witnesses; affidavit under
order XI Rule 6 CPC; list of documents with documents. The
defendant has not filed affidavit of admission and denial of
documents as per provisions of commercial Courts Act. Ld.
Counsel for the defendant submits that he needs two weeks time
to file the same. Let the same be filed with advance copy to the
counsel for the plaintiff.
Application under order VII rule 10 has already been
filed by the defendant. Copy already supplied. Counsel for the
plaintiff submits that he has received the copy of the same and
needs time to file the reply. He is also directed to supply advance
copy of the same to the counsel for the defendant and reply be
file atleast 10 days before the next date of hearing.
Counsel for the plaintiff also directed to file
replication along with affidavit of admission and denial of
documents, within statutory period of 45 days of receipt of copy
of written statement. Advance copy be given.
