In view of submissions, personal appearance of accused
Subba is exempted for today.
Accused Vaaris is absent despite calls. Hence, his bail bond
and surety bond are forfeited.
Issue NBWs against the accused Vaaris and notice under
Section 446 Cr. PC against his surety for next date.
In view of report on NBWs, issue process u/s 82 Cr. PC
against the accused Mustkeem through SHO concerned. Process server is
directed to publicly read the proclamation in the vicinity in which the
accused ordinarily resides; one copy of the process be also affixed to some
conspicuous part of the house or to some conspicuous place of such town
or village where the residence of the accused is located and, one copy of
the process be also affixed on the Notice Board of the Court/ conspicuous
part of the court premises.

Process server who executes the process u/s 82 Cr. PC shall
remain present in person before the court on NDOH for recording of his
statement.
Sureties Sheru and Mustafa have fails to secure presence of
accused Mustkeem despite process under Section 446 Cr. PC. Therefore
the penalty equivalent to surety bond i.e. Rs.30,000/- each is imposed upon
the sureties Mustafa and Sheru.
Issue warrants of attachment to the tune of Rs.30,000/- each
against the aforesaid sureties Mustafa and Sheru for next date.

applicant/accused Vaaris for cancellation of NBWs.

Accused Vaaris is present in person.
Sh. Dilshad A. Khan, Ld.counsel for the accused.
It is submitted by the accused that due to traffic jam he could
not appear on time. That the non appearance was neither intentional nor
deliberate. It is prayed that NBWs may kindly be cancelled.
Heard.
Taking into consideration the submissions made, the NBWs
against the accused Vaaris are cancelled. Accused is warned to remain
careful in future.
Be put up on date fixed i.e. 11.12.2024.
