ASHOK KUMAR GUPTA
S/O LATE SH LAXMAN DASS GUPTA Vs.
SAV LOGISTICS LIMITED
25.03.2026
Present: Sh. Kuldeep Kumar, Ld. Counsel for Plaintiff.
None for the Defendant.
An application for waiver of cost has been moved on
behalf of the plaintiff on the ground that plaintiff herein is a jobless
senior citizen.
On the last date of hearing, cost was imposed upon the
plaintiff for wasting precious judicial time. Time is a precious judicial
entity which ought to be sagaciously invested in expeditious disposal
of
lis pending before the court. Even on the last date of hearing, the
plaintiff herein was a senior citizen and it is not as if he has become
jobless only after imposition of cost. In case if the plaintiff is a senior
citizen and is facing some financial constraints, he should have been
all the more diligent in prosecuting his suit. I do not find any merits in
the application at hand. The application for waiver of cost stands
dismissed.
Plaintiff is directed to pay the cost by next date of
hearing.
Counsel for the plaintiff has placed on record another
application in the form of execution petition. At the very outset,
counsel for the plaintiff submits that he is not pressing upon said
application and shall be filing a separate execution petition for the
same.
In view of the same, the said application stands
dismissed as not pressed.
