time to file the written statement.
Ld. counsel for the defendant has submitted that the
defendant did not receive copy of certain documents filed along
with the plaint and has requested for some more time to file
reply.
Ld. counsel for the plaintiff has disputed this,
however, in order to avoid controversy, he has supplied a fresh
copy of the documents filed by the plaintiff in the suit.
Let the written statement and the reply to the
application under Order XXXIX Rules 1 and 2 be filed within 4
weeks with advance copy to the other side.
Let replication, if any, be filed within 4 weeks
thereafter with advance copy to the other side.
Both parties are directed to file affidavits of
admission-denial of documents within 4 weeks of filing of WS
with advance copy to the other side.

Both parties are directed to file list of proposed
issues on or before the next date of hearing with advance copy to
the other side.
The application under Order VIII Rule 1 CPC is
disposed of accordingly.
