Fresh appeal has been received by way of assignment. It be
checked and registered, as per rules.
Present: Sh. Shakti Upadhyay, Ld. Counsel for appellants.
1. The present appeal has been filed impugning judgment of
conviction dated 16.12.2025 and order on sentence dated 15.01.2026
passed by Ld. JMFC, NI Act-03, PHC, NDD in CC No. 5846/2020 titled
as M/s Reliant Packaging Films Pvt. Ltd. vs. M/s Viral Enterprises &
Ors., whereby the appellants herein were convicted for the offence under
Section 138 NI Act and was directed to pay a fine of Rs.7,60,394/- along
with simple interest thereon at 9% per annum from the date of filing of
the Criminal Complaint and upto the date of its payment/realization to the
complainant, within 60 days from the pronouncement of order on
sentence dated 15.01.2026. Perused.
2. Heard on the application u/s 430 of BNSS seeking
suspension of sentence and grant of bail till decision of the present
appeal.
3. Order on sentence of the appellants be suspended till the
disposal of present appeal subject to deposition of 20% of the total
fine/compensation amount by way of FD in name of Ld. District &
Sessions Judge, PHC, NDD, New Delhi within 60 days from today before
the Ld. Trial Court and on furnishing of personal bond in the sum of
Rs.50,000/- with one surety in the like amount to the satisfaction of Ld.
Trial Court within one week from today.
4. Let notice of the present appeal be issued to the respondent
on filing of PF through all available modes for the next date of hearing.
5. Put up for appearance of respondent, reply and arguments on
the present appeal on 10.07.2026.
6. TCR be summoned for the next date of hearing.
7. As prayed, a copy of this order be given dasti to the Ld.
Counsel for the appellant.
