Sh. Tariq Adeeb, counsel for the respondent no.5 & 6 along with
Mohd. Ishaque, Court Clerk, with Sh. Ahsan Jamal, Law Officer,
physically.
Counsel for the petitioner submits that he wants to withdraw the
present petition as respondents no. 1 to 4 (tenants) have already paid the
rent, therefore, now petitioner does not want to proceed the case further. It is
further submitted that respondent no. 5 & 6 are the performa parties.

Statement of the counsel for the petitioner has been recorded,
separately.
In view of the statement of the counsel for the petitioner, the
present petition stands disposed of as withdrawn.

Present: Sh. Insaf Ali, counsel for the plaintiff, physically.
Perusal of the case file, we find that plaintiff has not taken the
steps for issuance of process against the defendants.
Heard.
At this stage, Sh. Tariq Adeeb, counsel for Delhi Waqf Board is
present and he submits that service has not been affected upon the defendant
no.5, however, he has been informed about the pendency of the present suit.
At this stage, counsel for the plaintiff submits that he is not having
copy of the plaint and documents for supplying to defendant no.5.
Heard.
Again process be issued to all defendants on filing of PF/RC and
Courier returnable on 02.12.2021.
Steps be taken within two weeks from today.

In view of Sec.83 of Waqf Act, 1995, Waqf Tribunal is required to
be reconstituted as two Members of the Tribunal are not presently available.
Be awaited for the Notification to constitute the Tribunal.
At this stage, counsel for plaintiff submits that at least summons
be issued to the opposite parties in order to avoid delay, however, substantial
proceedings may be conducted in the presence of Tribunal.
Heard. Record perused.
Let summons of the suit be issued to all the defendants on filing
of PF, RC and courier for 29.04.2021.
Steps be taken within one week.
