This is an application u/s 482 BNSS filed on behalf of applicant/accused
Gautam Kumar for grant of anticipatory bail.
Present: Sh. Irfan Ahmed, regular Ld. Addl. PP for State.

Sh. Pankaj Gupta, Ld. counsel for the applicant/accused
(Through VC).
Ms. Jyoti Kumari, Ld. counsel for the applicant/accused is
physically present in the court.
Reply to the anticipatory bail application has already been filed.
At this stage, ld. Counsel for the applicant has submitted that the
application for cancellation of NBWs is pending before ld. CJM, Patiala
House Courts, New Delhi for 13.03.2026. He has further submitted that date
of birth of the applicant is 01.11.2011 and photocopy of a certificate in that
regard has also been supplied by the ld. Counsel for the applicant to the IO.
Ld. Counsel for the applicant has prayed that protection be given to the
applicant till next date of hearing before ld. CJM, Patiala House Courts, New
Delhi where the fact of date of birth and claim of juvenility has already been
raised and is pending for 13.03.2026.
Ld. Addl. PP for State upon instructions from the IO has
submitted that phone number of the applicant is registered in the bank
account in which cheated amount of Rs.14,000/- was transferred.

IO has submitted that he would verify the date of birth and
certificate of the applicant and would also file proper reply in that regard
before the court of ld. CJM, Patiala House Courts, New Delhi.
In view of above said submissions and in the interest of justice,
the applicant be not arrested till next date of hearing.
Put up for further reply and consideration on 19.03.2026.
Copy of the order be given dasti.
