Fresh suit is received by way of random allocation. It be checked
and registered.
Present : Ms. Kiran Mahajan, Ld. Counsel for the plaintiff.
This plaint was initially filed before the court in
Central District, Tis Hazari Courts and as per an application and
certified copy of order placed on the record, it was directed to be
returned vide order dated 23.09.2025 by Commercial Court no.7,
Central District, Tis Hazari.
On perusal of plaint, I find that there are number of
handmade additions and corrections without authentication.
Verification clause of the plaint is left blank and without date.
Affidavit under Order XI CPC is not as per given format for
commercial suit.
On next date AR of plaintiff shall appear in person
before the court and this would be last opportunity for plaintiff to
file complete set of rectified pleadings, strictly in accordance
with Commercial Courts Act.
Preliminary submissions shall be heard including
limitation aspect on the next date of hearing.
Put up on 25.03.2026 for preliminary submissions.
At the request of ld. counsel for plaintiff, the date of
25.03.2026 is changed to 04.04.2026.
