Pdf Text: Bail Application No. 327/2022
FIR No. 360/2021
PS Kishangarh
State Vs. Mukesh @ Sonu
07.04.2022
Present: Sh. Irfan Ahmed, Ld. Addl. PP for the State.
Sh. Manish Chauhan and Sh. Vijay Kataria, Ld. Counsels for
applicant/ accused.
Present is an application moved on behalf of applicant/
accused Mukesh @ Sonu for grant of bail.
It is submitted that the applicant /accused has been falsely
implicated in the present FIR as he has nothing to do with the alleged
offence and he is languishing in j.c since 03.01.2022. It is further submitted
that the applicant/ accused is not a previous convict and he belongs to a
respectable family and having deep roots in the society as such there is no
chance of his absconding or tampering with the prosecution evidence. It is
further submitted that investigation in the instant matter has already been
completed and chargesheet has already been filed and no fruitful purpose
would be served by keeping him behind the bars as trial in the instant
matter is likely to consume considerable time. It is further submitted that
applicant/ accused undertakes to abide by all terms and conditions, which
this Hon’ble court may impose upon him while granting him bail. It is
prayed that the instant application be allowed.
Ld. Addl. PP has vehemently opposed the present bail
application arguing that the first bail application of the applicant/accused
Mukesh @ Sonu was dismissed by the Hon’ble Court of Ld MM. It is further
submitted that if the accused Mukesh @ Sonu is released on bail, he would
be trying to destroy the evidence and threaten the witnesses.

Except for the disclosure statement of the accused persons, Ld.
Addl. PP has failed to point out any incriminating piece of evidence against
the applicant/ accused Mukesh @ Sonu.
Considering the period of incarceration, nature of evidence
against the applicant/ accused and the fact that the investigation in the
instant matter has already been concluded, applicant/accused Mukesh @
Sonu is admitted to bail on his furnishing bail bonds in the sum of Rs.
50,000/ with two sureties in the like amount to the satisfaction of Ld.
MM/Duty MM/Link MM. It is clarified that the bail bonds in the instant
matter shall be accepted after verification of the same.
Application is disposed off accordingly. Copy of the order be
given dasti to the concerned parties.
