Fresh criminal appeal received by way of assignment. It be checked and
registered.
Present: Appellant is present through VC.
Sh. M. K. Sharma and Sh. Ankit Gupta, ld. Counsels for
appellant.
It is submitted by Ld. Counsel for the appellant that he has
preferred the present appeal against the impugned judgment dated
16.12.2025 and order on sentence dated 14.01.2026 passed by Ld. JMFC,
NI Act-03, New Delhi District, Patiala House Courts.
Alongwith the appeal, appellant has moved an application
under section 430 BNSS for suspension of sentence during the pendency
of the appeal. It is submitted that the accused / appellant has been
sentenced to pay fine of Rs. 8,50,337/- alongwith simple interest thereon
at 9% per annum from the date of filing of complaint and upto the date of
its payment/realization to the complainant to the complainant for the
offence under section 138 of Negotiable Instrument Act. It is further
pleaded on behalf of the appellant that there are number of factual and
legal issues in the impugned judgment which are required to be heard in
detail and considered.

Application under section 430 BNSS moved on behalf of the
appellant is allowed. Execution of the sentence upon the appellant is
suspended subject to the condition that the appellant shall deposit 20% of

the compensation amount awarded by the Ld. Trial Court within 30 days
from today with Ld. Trial Court. He is admitted to bail till the disposal of
appeal on furnishing of personal bond in a sum of Rs. 30,000/- with one
surety of like amount to the satisfaction of Ld. Trial Court.

Notice of the appeal alongwith the copy of appeal be issued
to the respondent on filing of PF/RC, for NDOH within 7 days from
today.
TCR be summoned for NDOH.
A copy of this order be sent to the Ld. Trial Court for
information. Copy of this order be also given dasti as prayed for.
