None for R-3 despite service.
It is submitted on behalf of respondent no. 2 that
present revision petition is not maintainable before this Court as this
Court does not have territorial jurisdiction qua property in question.
It is further submitted that impugned order has been passed by
District Magistrate (South) and this revision petition ought to have
been filed in South District.
On the other hand, Ld. Counsel for petitioner has
shown the receipt of e-filing that initially the revision petition was
filed in South District on 04.02.2026 but same was not entertained
on the ground of territorial jurisdiction by filing officials of South
District.
Submissions heard. Record perused.
It is a matter of record that parties are contesting a civil
suit which is pending in the Court of Ld. ACJ (South), Saket Courts,
Delhi and the property in question is same in that suit also. It is also

not in dispute that impugned order has been passed by District
Magistrate (New Delhi).
Ld. Counsel for petitioner has rightly pointed out that
petitioner made his best efforts to file revision petition in
appropriate Court by filing the same in South District but same was
not entertained by filing officials, therefore, Ld. Counsel for
petitioner is requested to look into the concern of Ld. Counsel for
respondent whether this Court has territorial jurisdiction or not to
try this revision petition.
Petitioner is at liberty to pursue this revision petition
which is already filed in South District.
At joint request, matter is adjourned.
Interim order to continue till NDOH as ordered by
Hon’ble High Court of Delhi.
Re-list for further proceedings on 10.02.2026 at
2.00pm.
Copy of the order be given dasti, as prayed for.
