alongwith plaintiff and her son.
Mr. Ashish Dogra, Ld. Counsel for the defendant.
Ld. Counsels for the parties submit that talks of
settlement have failed and therefore the Court should proceed
further with the case.
Ld. Counsel for the defendant requests that half of the
cost imposed on the last date of hearing be waived since Ld.
Counsel for the defendant was not available since he had to take his
son to a school for an interview.
Record is perused.
In view of the personal grounds of Ld. Counsel for the
defendant mentioned before the court, a lenient view is taken and
cost of Rs. 10,000/- is reduced to Rs. 5,000/-.
Cost of Rs. 5,000/- is paid to Ld. Counsel for the
plaintiff.
Arguments on the application under Order 12 Rule 6 of
CPC are heard.

Order is reserved.

By separate order of even date, the application under
Order 12 Rule 6 of CPC is allowed. The defendant is directed to
handover vacant possession of Flat bearing No. G-102, Som
Vihar Housing Cooperative Society Ltd., R.K. Puram, New Delhi
as shown in red colour in the site plan filed by the plaintiff.
Decree sheet be prepared accordingly.
Let affidavits of admission and denial of documents
and proposed issues for the pending reliefs be filed by the next
date of hearing.
To come up for framing of issues on 16.07.2025.
