Ld. Counsel for the plaintiff submitted that the
possession of the suit property pursuant to order dated
04.04.2025 has been received by him on 31.05.2025 in execution
petition bearing no. 102/25.
Ld. Counsel for the plaintiff requests that issues be
framed.
As pleadings are complete, the following issues arise
and are hereby framed:-
ISSUES:-
1. Whether the plaintiff is entitled for decree for recovery of Rs.
6,10,939/- (i.e. Rs. 3,20,000/- arrears of rent amount for period
w.e.f. 01.11.2022 to 30.06.2023) and society maintenance
charges of Rs. 2,90,939/- upto 27.06.2023? OPP
2. Whether the plaintiff is entitled for decree directing the
defendant to pay rent/damages @Rs. 40,000/- per month w.e.f.
21.08.2023 till handing over peaceful vacant physical possession
of the suit property i.e. till 31.05.2025? OPP.
3. Whether the plaintiff is entitled for decree directing the
defendant to continue to pay electricity charges, water charges
and maintenance charges etc. till handing over peaceful vacant
physical possession of the suit property i.e. till 31.05.2025? OPP.

4. Whether the plaintiff is entitled for the interest @18% p.a. on
the above said amounts till realization? OPP.
5. Whether the plaintiff is entitled to the costs of the suit? OPP.
6. Relief.
No other issue arises or is pressed for.
List of witnesses be filed by the parties within two
weeks from today after supplying advance copies to the opposite
party. Advance copy of evidence by way of affidavit be supplied
to the defendant at least one week prior to the next date of
hearing.
To come up for PE on 29.07.2025.
