Ld. Counsel for the claimant submits that initially they filed a claim
petition in Central District, Tis Hazari Court vide case no. MACT 717/25 which
was withdrawn due to lack of jurisdiction vide order dated 09.01.2026 passed by
the Court of Ms. Ruchika Singla, PO MACT-01, Central, Tis Hazari Court, Delhi.
Ld. Counsel for the claimant submits that the office of insurance
company is situated within the jurisdiction of this Tribunal and no other
DAR/Claim Petition is pending in any other Court in India.
Ld. Counsel for the claimant submits that they have filed on record
certified copy of charge-sheet wherein R-1/Driver has been charge-sheeted. He
submitted that R-2 is the owner, R-3 and R-4 are the insurance company and Nodal
Officer of the Insurance company.
Notice of claim petition be issued to all the Respondents with
direction to appear in person or through representative on the next date of hearing.
Notice be also provided dasti by the claimant for effecting service.
List this matter for further proceedings on 15.07.2026.
