None for the defendant.
One application under Order XVI rule 6 read with
Section 30 (B) CPC was filed on behalf of plaintiff, thereby
seeking summoning of KYC documents furnished by defendant
to his banker. It is submitted by ld. counsel that on 12.12.2025,
advocate of defendant had handed over certain cheques towards
part payment. Photocopy of those two cheques were filed on the
record. The cheques were issued out of the account being
maintained in HDFC bank Safdarjung Enclave, New Delhi.
Subsequently, no one has been appearing for defendant and
plaintiff is not aware of any other address of the defendant, hence
this application was moved to seek about correct present address
of the defendant on the basis of KYC documents furnished by
defendant to his bank.
It is a matter of record that there is no service report
regarding the defendant. Though one advocate appeared in the
past, without filing any vakalatnama for the defendant, however,
he also stopped appearing. In these circumstances, issue court
notice to manager HDFC bank, Safdarjung Enclase, New Delhi
to furnish latest address along with supporting documents of
KYC in respect of account holder namely ‘Paper Bag World’
having account number 50200077328716.
